ABSTRACT:In response to criticism of empirical or “positive” approaches to corporate social responsibility (CSR), we defend the importance of these approaches for any CSR theory that seeks to have practical impact. Although we acknowledge limitations to positive approaches, we unpack the neglected but crucial relationships between positive knowledge on the one hand and normative knowledge on the other in the implementation of CSR principles. Using the structure of a practical syllogism, we construct a model that displays the key role of (...) empirical knowledge in fulfilling a firm’s responsibility to society, paying special attention to the implications of the “ought implies can” dictum. We also defend the importance of one particular class of empirical claims; namely, claims from the field of economics. Even positive economic theory, which is often criticized for endorsing profits rather than values, can cooperate in intriguing ways with non-economic concepts in the implementation of CSR goals. The conception of social justice presented and defended in Philippe Van Parijs, "Real Freedom for All" entails, among other implication, the justification of an unconditional basic income. It was the subject of seven critical comments that forms issue 22 and part of 23 of ANALYSE & KRITIK. In this article, Van Parijs offers a comprehensive reply.

If one is committed to a “Rawlsian” conception of justice, is one not also necessarily committed to a “Christian” personal ethics? MOE explicitly, if one believes that social justice requires the maximinning of material conditions, should one not use one's time and resources as well as one can in order to assist the poorest? The paper offers a very partial answer to these questions by arguing for the following two claims: (1) Contrary to what is implied by some egalitarian critics (...) of Rawls, the idea of a well‐ordered society does not require maximin‐guided choices at the individual level, and hence leaves room for legitimate incentive payments.(2) Despite Rawls's own neglect of this fact, a limited form of patriotism does constitute an individual “natural duty” following from a commitment to maximin social justice. How is it possible, at the same time, to claim that there is a causal primacy of the productive forces over the relations of production and to recognize that the development of the productive forces causally depends on the nature of the relations of production? This irritating puzzle, which threatens the very core of historical materialism, had never received a satisfactory solution until G. A. Cohen's Karl Marx's Theory of History. The latter asserts that only a functional interpretation of historical (...) materialism can effect the required reconciliation. On one reading of the "primacy puzzle", however, this claim turns out to be trivial, while on the only other plausible reading it turns out to be false. Having delineated this dilemma, the article sketches an alternative solution. (shrink)

In recent years, to protect the rights and welfare of human subjects, institutions in the USA have begun to set up programmes to monitor ongoing medical research. These programmes provide routine, onsite oversight, and thus go beyond existing oversight such as investigating suspected misconduct or reviewing paperwork provided by investigators. However, because of a lack of guidelines and evidence, institutions have had little guidance in setting up their programmes. To help institutions make the right choices, we used interviews and document (...) analysis to study how and why 11 US institutions have set up their monitoring programmes. Although these programmes varied considerably, we were able to distinguish two general types. ‘Compliance’ programmes on the one hand were part of the institutional review board office and set up to ensure compliance with regulations. Investigators’ participation was mandatory. Monitors focused on documentation. Investigators could be disciplined, and could be obliged to take corrective actions. ‘Quality-improvement’ programmes on the other hand were part of a separate office. Investigators requested to be monitored. Monitors focused more on actual research conduct. Investigators and other parties received feedback on how to improve the research process. Although both types of programmes have their drawbacks and advantages, we argue that if institutions want to set up monitoring programmes, quality improvement is the better choice: it can help foster an atmosphere of trust between investigators and the institutional review board, and can help raise the standards for the protection of human subjects. The aim of this review is to show the fruitfulness of using images of facial expressions as experimental stimuli in order to study how neural systems support biologically relevant learning as it relates to social interactions. Here we consider facial expressions as naturally conditioned stimuli which, when presented in experimental paradigms, evoke activation in amygdala–prefrontal neural circuits that serve to decipher the predictive meaning of the expressions. Facial expressions offer a relatively innocuous strategy with which to investigate these normal variations (...) in affective information processing, as well as the promise of elucidating what role the aberrance of such processing might play in emotional disorders. Emotions are traditionally considered to be brief states that last for seconds or a few minutes at most. However, due to pioneering theoretical work of Frijda and recent empirical studies, it has become clear that the duration of emotions is actually highly variable with durations ranging from a few seconds to several hours, or even longer. We review research on determinants of emotion duration. Three classes of determinants are identified: features related to the emotion-eliciting event, emotion itself, and emotion-experiencing person. Public announcement logic is an extension of multiagent epistemic logic with dynamic operators to model the informational consequences of announcements to the entire group of agents. We propose an extension of public announcement logic with a dynamic modal operator that expresses what is true after any announcement: after which , does it hold that Kφ? We give various semantic results and show completeness for a Hilbert-style axiomatization of this logic. There is a natural generalization to a logic for arbitrary events.

Report of the symposium 'Towards a Philosophy of Systems Biology' held at the Vrije Universiteit of Amsterdam (VUA), the Netherlands, from 2 to 3 June 2005.

Models not only represent but may also influence their targets in important ways. While models’ abilities to influence outcomes has been studied in the context of economic models, often under the label ‘performativity’, we argue that this phenomenon also pertains to epidemiological models, such as those used for forecasting the trajectory of the Covid-19 pandemic. After identifying three ways in which a model by the Covid-19 Response Team at Imperial College London may have influenced scientific advice, policy, and individual responses, (...) we consider the implications of epidemiological models’ performative capacities. We argue, first, that performativity may impair models’ ability to successfully predict the course of an epidemic; but second, that it may provide an additional sense in which these models can be successful, namely by changing the course of an epidemic. A compromise is an agreement that involves mutual concessions. Each party gets less than it feels entitled to, but agrees to it because the situation it anticipates under the deal is better than the one it expects in the absence of a deal: conflict, exit or arbitration by a third party. Some compromises, however, are bad, and others are good. This article discusses three conjectures about what it is that makes a compromise good. Is a good compromise an honourable compromise, (...) one that enables each party to save face? Is it rather a fair compromise, one that contributes to the progress of justice independently defined? Or is it a Pareto-improving compromise, one that changes things in such a way that it ends up making everyone better off than under the status quo? A compromise is never as good as a consensus, but it is generally better than nothing, and often achievable when a consensus is not. And when it is, trying to make it as good as possible in each of the three ways described is always worthwhile. © 2012 Government and Opposition Ltd. (shrink)

La pensée du jurisconsulte anglais Jeremy Bentham (1748-1832) se prête particulièrement bien à une approche interdisciplinaire telle que celle qui est menée dans le présent ouvrage. Si Bentham, en effet, a consacré l'essentiel de ses travaux à des projets de réforme de la société anglaise de son temps par le biais de la codification des lois, il n'a cessé d'enrichir cette réflexion par des emprunts faits à d'autres disciplines, dans lesquelles il était également passé maître, telles la morale, la psychologie, (...) la logique, la théorie du langage, l'économie ou la politique.Cette pensée, à la fois plurielle et ambiguë (est-elle conservatrice, réformiste, révolutionnaire ou utopique? Est-elle descriptive, explicative ou normative?), révèle aujourd'hui son étonnante actualité. Il est peu de thèmes juridiques contemporains qui ne trouvent en effet leur place dans l'oeuvre de Bentham : ainsi les questions de l'utilité, de la balance des intérêts, de la constitution d'une science du droit et d'une logique déontique ; ainsi les concepts de système juridique, de codification, de déontologie, de contrôle social, d'opinion publique et de majorité politique. L'intérêt de cette « relecture » de la pensée de Bentham réside dès lors sans doute moins dans l'exégèse de ses multiples détours que dans la mise en lumière de ses ambiguïtés et de ses limites qui, pour une large part, sont aussi les nôtres. Parmi celles-ci, l'oscillation constante, déjà inscrite dans les textes benthamiens, entre deux figures de l'État moderne (État libéral et État-providence), n'est sans doute pas la moins actuelle. At the beginning of the COVID-19 pandemic, high hopes were put on digital contact tracing, using mobile phone apps to record and immediately notify contacts when a user reports as infected. Such apps can now be downloaded in many countries, but as second waves of COVID-19 are raging, these apps are playing a less important role than anticipated. We argue that this is because most countries have opted for app configurations that cannot provide a means of rapidly informing users of (...) likely infections while avoiding too many false positive reports. Mathematical modelling suggests that differently configured apps have the potential to do this. These require, however, that some pseudonymised data be stored on a central server, which privacy advocates have cautioned against. We contend that their influential arguments are subject to two fallacies. First, they have tended to one-sidedly focus on the risks that centralised data storage entails for privacy, while paying insufficient attention to the fact that inefficient contact tracing involves ethical risks too. Second, while the envisioned system does entail risks of breaches, such risks are also present in decentralised systems, which have been falsely presented as ‘privacy preserving by design’. When these points are understood, it becomes clear that we must rethink our approach to digital contact tracing in our fight against COVID-19. There are no data in this work. (shrink)

Utopian thinking consists of formulating proposals for radical reforms, justifying them on the basis of normative principles combined with the best possible scientific analysis of the root causes of the problems the proposals are meant to address, and subjecting these proposals to unindulgent critical scrutiny. Such utopian thinking is indispensable, and contributing to it is part of sociology’s core business. This article illustrates these claims by considering one particular utopian proposal: an unconditional basic income paid to every member of society (...) on an individual basis, without means test or work requirement. It summarizes the main arguments that support this proposal, mentions a number of contexts in which it is being taken seriously, and sketches a number of ways in which sociological insights and research are crucially relevant to the discussion of the economic and political sustainability of an unconditional basic income. How could the initial, drastic decisions to implement “lockdowns” to control the spread of COVID-19 infections be justifiable, when they were made on the basis of such uncertain evidence? We defend the imposition of lockdowns in some countries by first, and focusing on the UK, looking at the evidence that undergirded the decision, second, arguing that this provided us with sufficient grounds to restrict liberty given the circumstances, and third, defending the use of poorly-empirically-constrained epidemiological models as tools that can (...) legitimately guide public policy. Were governments justified in imposing lockdowns to contain the spread of the COVID-19 pandemic? We argue that a convincing answer to this question is to date wanting, by critically analyzing the factual basis of a recent paper, “How Government Leaders Violated Their Epistemic Duties During the SARS-CoV-2 Crisis” (Winsberg et al. 2020). In their paper, Winsberg et al. argue that government leaders did not, at the beginning of the pandemic, meet the epistemic requirements necessitated to impose lockdowns. We focus on (...) Winsberg et al.’s contentions that knowledge about COVID-19 resultant projections were inadequate; that epidemiologists were biased in their estimates of relevant figures; that there was insufficient evidence supporting the efficacy of lockdowns; and that lockdowns cause more harm than good. We argue that none of these claims are sufficiently supported by evidence, thus impairing their case against lockdowns, and leaving open the question of whether lockdowns were justified. (shrink)

The comprehension of living organisms in all their complexity poses a major challenge to the biological sciences. Recently, systems biology has been proposed as a new candidate in the development of such a comprehension. The main objective of this paper is to address what systems biology is and how it is practised. To this end, the basic tools of a systems biological approach are explored and illustrated. In addition, it is questioned whether systems biology ‘revolutionizes’ molecular biology and ‘transcends’ its (...) assumed reductionism. The strength of this claim appears to depend on how molecular and systems biology are characterised and on how reductionism is interpreted. Doing credit to molecular biology and to methodological reductionism, it is argued that the distinction between molecular and systems biology is gradual rather than sharp. As such, the classical challenge in biology to manage, interpret and integrate biological data into functional wholes is further intensified by systems biology’s use of modelling and bioinformatics, and by its scale enlargement.
